Terms of Service

By accessing, browsing, or using FapperAI (the "Platform") in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms in their entirety, you must immediately cease all use of the Platform. Your continued use of the Platform constitutes ongoing acceptance of these Terms as they may be updated from time to time.

You must be at least 18 years of age to use this Platform. By creating an account or using the Platform in any way, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding agreement; (c) accessing and viewing adult content is legal in your jurisdiction; and (d) you are not located in a jurisdiction where such content is prohibited. We reserve the right to verify your age at any time and to immediately terminate any account that violates this requirement without notice or refund.

You may create an account using email or third-party authentication providers (Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration.

Anonymous access is available with limited functionality. Anonymous sessions are identified by a hashed, non-reversible identifier derived from your connection. No personal information is stored for anonymous users.

FapperAI is an adult entertainment platform featuring AI-generated fictional characters. All characters, conversations, images, audio, and video content are entirely fictional and generated by artificial intelligence. No real persons are depicted, represented, or involved in the creation of content. Any resemblance to real individuals is purely coincidental and unintentional.

By using the Platform, you expressly acknowledge and agree that:

• All characters are AI-generated fictional personas, not real people, and no real human interaction is occurring
• All images, voice, and video content are synthetically generated and do not depict real persons
• Conversations are powered by AI language models that may produce inaccurate, inconsistent, or unexpected outputs
• Content may be explicit and sexually graphic in nature, and you access such content voluntarily and at your own risk
• AI-generated content should not be relied upon for factual information, advice, or guidance of any kind
• You will not hold FapperAI liable for any emotional, psychological, or other impact resulting from interactions with AI characters

You agree not to, and will not attempt to:

• Use the Platform if you are under 18 years of age
• Attempt to generate content depicting minors in any context whatsoever
• Use the Platform for any illegal purpose or in violation of any applicable law or regulation
• Share, sell, or transfer your account credentials to any third party
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code or underlying AI models, algorithms, or training data
• Use automated tools, bots, scrapers, or any other programmatic means to access or interact with the Platform
• Circumvent, disable, or interfere with usage limits, access controls, security features, or payment requirements
• Harass, threaten, abuse, defame, or intimidate other users, our staff, or our support team
• Upload, transmit, or share content that violates any law, infringes third-party rights, or contains malware or harmful code
• Use the Platform to create content that impersonates or misrepresents real individuals
• Redistribute, publish, or commercially exploit any content generated by the Platform

Violation of any of the above may result in immediate account suspension or termination without prior notice and without refund. We reserve the right to report illegal activity to the appropriate law enforcement authorities.

The Platform offers subscription tiers and credit-based purchases. All payments are processed securely through Stripe. By making any purchase on the Platform, you expressly acknowledge and agree to the following:

• Subscriptions are billed on a recurring cycle (weekly, monthly, or yearly depending on the product) and automatically renew unless cancelled before the next billing date
• You can cancel your subscription at any time; access continues until the end of the current billing period, and no refund or pro-rata credit will be issued for the remaining time in that period
• Credits are non-refundable, non-transferable, and do not expire
• Subscription prices may vary by character and tier and are subject to change with reasonable notice
• Free trial messages are provided per character; once used, a subscription or credits are required to continue
• By completing a purchase, you acknowledge that digital content delivery begins immediately and you expressly consent to waive any applicable cooling-off or withdrawal period
• You are solely responsible for managing your subscription, including cancellation before renewal dates

We will send email confirmations for purchases, payment failures, subscription renewals, and cancellations to the email address associated with your account or payment method.

All purchases on the Platform are final. Because the Platform delivers digital content and services that are consumed immediately upon access, refunds are generally not available once the service has been provided or digital content has been accessed.

A refund may be considered solely at our discretion and only in the following limited circumstances:

• A verified technical failure on our end that completely prevented you from accessing the paid service for the entirety of the billing period, and you reported the issue to us within 7 days of the charge
• A duplicate charge resulting from a system error (not from multiple intentional purchases)
• An unauthorized charge, provided you report it within 14 days and cooperate with our investigation

The following are expressly non-refundable under any circumstances:

• Credit pack purchases, whether used or unused
• Subscription periods during which you had access to the service, regardless of actual usage
• Partial billing periods after cancellation
• Purchases where the service was delivered as described, even if the content did not meet your subjective expectations
• Charges resulting from failure to cancel before a renewal date
• Accounts terminated for violation of these Terms

To request a refund under the eligible circumstances above, contact [email protected] within the applicable timeframe with your transaction details. All refund decisions are final and made at our sole discretion. Filing a chargeback or payment dispute without first contacting us may result in immediate account termination.

Each subscription tier includes daily limits for text messages, voice replies, video clips, and image generation. Limits reset daily at midnight UTC. Free and anonymous users receive limited trial access. We reserve the right to adjust usage limits with reasonable notice.

The Platform integrates with the following third-party services:

• Telegram - Optional integration for receiving character messages via the Telegram messaging app. You may link and unlink your Telegram account at any time from your profile settings.
• The Handy - Optional integration with the Handy interactive device. Connection requires your device key, which you provide voluntarily. You can disconnect at any time. You acknowledge that use of the Handy device is entirely at your own risk and FapperAI bears no responsibility for any physical injury, discomfort, or device malfunction.

Use of third-party integrations is subject to those services' own terms and privacy policies. FapperAI is not responsible for the availability, functionality, security, or privacy practices of any third-party service. Your use of third-party integrations is at your own risk and governed by those third parties' respective terms.

All AI-generated content, character designs, voice models, platform code, trademarks, and any other intellectual property on the Platform are the exclusive property of FapperAI or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial entertainment purposes.

You may not reproduce, redistribute, sell, sublicense, publicly display, or commercially exploit any content generated by or obtained through the Platform without our prior written consent. This license may be revoked at any time, with or without cause, at our sole discretion.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, we make no warranty or representation that: (a) the Platform will meet your requirements or expectations; (b) the Platform will be uninterrupted, timely, secure, or error-free; (c) AI-generated content will be accurate, reliable, complete, or appropriate; (d) any defects or errors will be corrected; or (e) the Platform or the servers that make it available are free of viruses or other harmful components.

You use the Platform entirely at your own risk. AI characters may generate content that is offensive, inaccurate, inappropriate, or inconsistent. We assume no responsibility for the nature, quality, or suitability of AI-generated outputs.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAPPERAI, ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

Without limiting the above, FapperAI shall not be liable for any damages, injury, or harm arising from: (a) your use of third-party integrations including the Handy device; (b) emotional, psychological, or physical effects from interacting with AI characters; (c) unauthorized access to your account resulting from your failure to safeguard your credentials; (d) actions taken by third-party services; or (e) any content you create, upload, or share through the Platform.

You agree to indemnify, defend, and hold harmless FapperAI, its owners, operators, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party rights; or (e) any content you upload or transmit through the Platform.

We may suspend or terminate your account immediately and without prior notice at our sole discretion if we determine that you have violated these Terms, engaged in abusive or fraudulent behavior, or if required by law. Upon termination: (a) your right to access the Platform ceases immediately; (b) no refund will be issued for any remaining subscription period, unused credits, or any other prepaid services; (c) we are not obligated to retain, return, or provide a copy of your data; and (d) any provisions of these Terms that by their nature should survive termination shall remain in effect.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation by contacting [email protected]. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered in accordance with applicable arbitration rules. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against FapperAI.

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Material changes will be communicated via email or an in-app notification at least 14 days before they take effect. Your continued use of the Platform after the effective date of any modifications constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Platform.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FapperAI regarding your use of the Platform and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
